These Terms of Service (“Terms”) govern access to and use of the platform, mobile apps, and website provided by Gradus Technologies Pvt. Ltd.(“Gradus”). By using the Services, the subscribing school and its authorized users agree to these Terms.
1. Accounts & eligibility
Gradus is provided to schools and their authorized administrators, staff, parents, and students. Schools are responsible for the accuracy of the information they provide and for the activity that happens under accounts they create. Keep your credentials confidential and notify us promptly of any unauthorized use.
2. Acceptable use
You agree not to:
- Use the Services for any unlawful purpose or in violation of any applicable regulation.
- Upload data you do not have the right to share, or attempt to access data outside your role.
- Reverse-engineer, disrupt, overload, or probe the Services or their security.
- Resell, sublicense, or misrepresent the Services as your own.
3. Your data
Schools retain all rights to the data they upload (“Customer Data”). You grant Gradus a limited license to host and process Customer Data solely to provide and improve the Services, as described in our Privacy Policy. We do not sell Customer Data or use student data for advertising.
4. Subscriptions & fees
Paid plans are billed according to the quote agreed with your school. Pricing scales with school size, with no hidden fees and no lock-in. Unless stated otherwise, fees are non-refundable for periods already served. We will give reasonable notice of any pricing changes.
5. Service availability
We target 99.9% uptime and work hard to keep the Services fast and reliable. From time to time we may perform maintenance or release updates; we aim to minimize disruption and to give notice of significant scheduled maintenance.
6. Intellectual property
The Services, including all software, design, and branding, are owned by Gradus and protected by applicable laws. These Terms do not transfer any Gradus intellectual property to you beyond the right to use the Services during your subscription.
7. Term & termination
Either party may end the subscription in accordance with the agreed plan. We may suspend access if these Terms are breached in a way that risks the security or integrity of the Services. On termination, we will delete or return Customer Data as described in our Privacy Policy.
8. Disclaimers
The Services are provided “as is”. To the maximum extent permitted by law, Gradus disclaims implied warranties and does not warrant that the Services will be uninterrupted or error-free. AI- generated evaluations are intended to assist educators, not to replace professional judgment.
9. Limitation of liability
To the extent permitted by law, Gradus will not be liable for indirect, incidental, or consequential damages, and our total liability for any claim is limited to the fees paid for the Services in the 12 months preceding the claim.
10. Governing law
These Terms are governed by the laws of India, and the courts of Delhi will have jurisdiction over any disputes, without prejudice to mandatory local consumer protections.
11. Changes to these Terms
We may update these Terms as the Services evolve. We will notify subscribing schools of material changes, and continued use after changes take effect constitutes acceptance.
